About this Webinar

In this session, five Haber Law attorneys, Rebecca Casamayor, Jonathan Goldstein, Marnie Dale Ragan, Darrin Gursky, and Kyle Alonso, walk HOA board members through their legal obligations under Florida’s Homeowners Association Act, covering fiduciary duty and board liability, governing documents and covenant preservation, architectural control, records requests, collections and foreclosure defenses, association contracts, and borrowing.

The Key Learning Objectives for this Course are as Follows:

  • Describe the core responsibilities board members owe to their community, including acting in good faith, making informed decisions, and putting the association’s interests ahead of personal interests.
  • Explain how to properly schedule, notice, and conduct board meetings and elections, including required timeframes for posting notices, rules for voting, and how to fill board vacancies.
  • Recognize what the association can and cannot do when enforcing community rules, including limits on fines, required steps before penalizing a homeowner, and restrictions on regulating what owners do inside their homes or out of public view.
  • Identify what records the association must keep and how homeowners can access them, including how long records must be retained, deadlines for responding to owner requests, what personal information must be kept private, and when records must be posted online.
  • Understand the criminal consequences board members can face for misconduct, including penalties for destroying records, accepting kickbacks, rigging elections, misusing association funds, and when a director must be removed from the board.

Rebecca has particular expertise representing condominium and homeowners’ associations in governance, operations, and legal compliance, from covenant enforcement to collections and foreclosures. She frequently presents educational courses for board members on legislative updates and legal trends.
