Construction Defect Litigation
Haber Law has successfully led some of the largest construction defect cases in South Florida, representing property owners, developers, community associations and construction professionals. We handle every phase of construction litigation, including construction and design defect litigation, including claims for building code violations, breach of warranty claims and breach of contract claims. We handle matters from the Florida Statutes Chapter 558 pre-suit process through trial, always prioritizing our client’s financial interests and property values.
Notably, we secured one of the largest settlements in Palm Beach County history, which involved 34 defendants, 50 law firms, and 40 insurance carriers. It was so large that a special courtroom had to be constructed, with a jury pool of 300 citizens summoned for trial.
Some publicized and significant settlement values for high-profile properties that our team has obtained include the following:
- $26.1 MILLION – San Matera (West Palm Beach)
- $17.5 MILLION – Regalia (Sunny Isles)
- $9.2 MILLION – Continuum, South Tower (South Beach)
- Numerous confidential 7-figure and 8-figure construction defect lawsuit settlements for high rise condominium associations.

In addition to litigating large, multi-party construction defect lawsuits, we regularly handle all types of construction disputes that might arise during a construction project or that follow a construction project’s completion, including breach of contract claims, business tort claims, insurance claims, lien claims, fraudulent lien claims, bond and surety claims, delay claims, and payment disputes as between owner and contractor or contractor and subcontractor.
